As has been widely reported, the City of Asbury Park has retained the services of retired New Jersey Supreme Court Justice Lee A. Solomon to review the City's options for suing the Beachfront redeveloper, to take back the boardwalk buildings based on their failure to redevelop them.
One of the issues His Honor is reviewing is the contention of this office that the Casino and Power Plant complexes are not governed by the 2010 Redeveloper Agreement, rather the 2002 Redeveloper Agreement.
The Casino and Power Plant are treated differently than other buildings in the contracts.
The 2002 contract allows the City to take back the Casino and Power Plant.
We have filed an extensive Memorandum of Law and Appendix to assist Justice Solomon in his review of our contentions.
